A patent application filed in recent years, can take up to two years to receive a first action from the US Patent Office and an year or more after that for the patent to be granted or rejected. The US Patent Office is seriously backlogged with 1.2 million unexamined applications. David Kappos, Director at US Patent Office, has proposed several initiatives to speed up processing of patent applications.
3-Track Proposal (June 2010)
Applications can receive an accelerated examination (Track 1) for an additional fee of $4,000, have the normal examination (Track 2) as they receive today or be delayed (Track 3) and have a slowed examination process which gives an applicant up to 30 months to defer the start of the examination process.
Green Technology Pilot Program
The US Patent Office recommends that patents for environmentally friendly products should be accelerated. The applicant is required to request for an early publication which requires a $300 fee.
Patent Prosecution Highway
The US Patent Office promises a 12 month examination for patents filed in multiple countries.
